《民律大全》（Corpus Iuris Civilis），或曰《國法大全》、《羅馬律全書》，古羅馬律書也。乃東羅馬敕修四部律之合。



沿革


皇朝末造，訴訟一準敕條。然自共和末至皇朝，歷朝律令盈於幾閣，典者不能遍睹。東朝帝優士丁尼立志中興羅馬，欲酌中制以垂後世。五二八年命特裡波尼等十人刪定前朝敕令，分門編輯為十二卷，是為《優帝編敕》，五三四年更定。五三零年，復命特裡波尼等十六人集四十律博士著述五十餘說，編成《學說匯纂》五十卷；又增訂蓋尤斯《律學進階》四卷，以為欽定明法科經。五六五年，優帝崩。後人集優帝五三四年至五五五年散敕一百六十八條，是為《優帝新編敕》。《優帝編敕》、《學說匯纂》、《律學進階》、《優帝新編敕》合謂曰《民律大全》。


《民律大全》集羅馬律之大成。法、德制民律皆摹之。近世華夏律仿法、德，亦不脫《民律大全》之窠臼。蓋中外之民律，無出羅馬律之右者。
